About The Role

We are seeking a strategic attorney with brand protection experience to lead our global efforts in safeguarding the Arduino brand. This role requires an individual with a proven track record in online brand protection, including expertise in combating counterfeit goods, unauthorized use of intellectual property (IP), and digital infringement across e-commerce platforms, social media, and domain names. The ideal candidate should be adept at operating within a large, global organization, engaging effectively with cross-functional teams, and managing relationships with leadership and US-based in-house and outside counsel. Additionally, the ideal candidate should have experience and a keen interest in leading 'evangelization efforts' with both internal and external stakeholders to effectively integrate brand protection principles and practices across the entire organization, as well as experience advising and counseling in-house marketing teams.

Job Responsibilities

Design, lead and execute a comprehensive global online brand protection strategy, specifically targeting and eliminating counterfeit products and IP infringement across major international e-commerce sites (e.g., Amazon, Alibaba, eBay), websites, and social media platforms. Manage the relationship with our specialized brand enforcement provider, ensuring high-quality, cost-effective, and timely and accurate removal of infringing content and products. Develop and deliver evangelization efforts (e.g. training, seminars) to internal teams and external partners on brand protection policies and best practices. Act as the primary point of contact for on all brand enforcement matters, providing detailed case documentation, strategic recommendations, and ensuring alignment with global legal objectives. Develop and maintain strong, collaborative relationships with senior management across Sales, Legal, Product Development and Marketing teams to ensure a unified and consistent approach to brand protection. Conduct in-depth market surveillance and analysis to identify emerging threats, key infringers, and new platforms requiring brand protection efforts, and regularly report findings to senior leadership. Manage Arduino’s trademark and copyright portfolios; coordinate with paralegals and outside counsel to prepare trademark applications, draft responses to office actions, develop evidence of use, and obtain registrations and renewals of trademarks. Review trademark clearance opinions from outside counsel and provide clear, business-focused advice and risk analyses. Draft and negotiate trademark license agreements and provide strategic advice to internal clients on building and managing trademark licensing programs. Provide advice on advertising issues, disclaimers and disclosures, claims substantiation, and consumer protection issues; collaborate with paralegals on marketing asset reviews. Draft and negotiate a variety of agreements relating to marketing and advertising, events, contests, sweepstakes, sponsorships, content licensing (both inbound and outbound), influencers, brand ambassadors, and social media. Advise clients and cross-functional teams on marketing, trademark and copyright aspects of commercial transactions, product/service development, and business strategies; counsel on advertising, marketing and consumer protection issues.

Minimum Qualifications:

Bachelor's degree.

OR

Associate's degree and 2+ years of relevant work experience.

OR

High School Diploma or equivalent and 4+ years of relevant work experience.

Minimum Qualifications:

Juris Doctorate degree or international equivalent. 2+ years’ experience practicing intellectual property law in an in-house or law firm setting, with an emphasis on trademark law; OR 5 years’ experience in brand protection or intellectual property enforcement, whether in-house or at a renowned brand protection service provider. Active bar license to practice law in the state or jurisdiction where the employee will be practicing (or ability to obtain upon hiring). Demonstrated expertise in online enforcement and anti-counterfeiting programs, including a deep working knowledge of the policies and takedown procedures for major international e-commerce platforms (e.g., Amazon Brand Registry, Alibaba IP Protection). Proven ability to manage a complex trademark portfolio and coordinate enforcement efforts across multiple jurisdictions. Proficiency in using brand protection monitoring tools and the ability to analyze enforcement data, generate strategic insights, and prepare executive-level reports. A solid understanding of global intellectual property laws and international trade regulations impacting brand protection. Excellent communication skills; ability to build and foster strong relationships with clients and colleagues at all levels. Native-level fluency in written and spoken English. Proficiency in other languages relevant to global e-commerce and brand enforcement (e.g., Mandarin, Spanish) is a significant advantage.

Preferred Qualifications:

5+ years’ experience practicing intellectual property law in an in-house or law firm setting, with an emphasis on trademark law. 3+ years’ experience counseling marketing teams in an in-house or law firm setting. Strong drafting and negotiating skills, with demonstrated ability to manage multiple, complex legal transactions simultaneously and drive them to close. Superior academic credentials and a willingness to learn and grow. Organized, detail-oriented, hard-working. Ability to work with little supervision, to multi-task and to take ownership of work in a fast-paced environment. Ability to explain and simplify complex legal concepts for internal clients in a practical way, focusing on balancing legal risks and business objectives. Business focus and pragmatism; enthusiasm for brands and marketing. References to a particular number of years experience are for indicative purposes only.
